Child Custody & Visitation
Experience Matters
Child Custody Overview
Child custody matters can originate from unmarried individuals with a minor child in common but can also be a contentious element of a divorce; either way, our office can represent you. A simple web search for “child custody in Nevada” will reveal that Nevada “prefers” that parents share joint physical custody, but this expression just scratches surface of the issues that often present themselves in custody matters.
Child custody matters will generally require the resolution of the following issues: legal custody, physical custody, and child support (including health insurance). Often, one parent raises concerns regarding suitability or fitness of the other parent, and the concerned parent will request “primary” physical custody, or even “sole” physical custody in extreme circumstances. Sometimes a parent does not cooperate with educational, or medical decisions, and a parent is even awarded “sole” legal custody. Our office has experience litigating all of these issues, as well other claims such as child support arrears, tax deductions, relocation, private schooling, vaccinations, etc.
Our Protocol
Your Attorney Must Understand the Judges
In addressing our clients’ concerns regarding child custody, we start by addressing general concerns and determining a range of realistic expectations. We continuously approach settlement discussions with open ears, but we are always prepared to litigate. Child custody cases are often “fact-intensive,” which means that the “little things” can often carry immense importance. The family court judges are mandated to determine what is in a child’s “best interests” when making custody orders, which is determined by a long list of factors. Safe to say – your attorney needs to know each judge’s preferences regarding these factors. Our office has appeared in front of each and every family court judge that is currently “on the bench”; that experience is what guides our advice and decisions for your benefit.
